Roger Terms of Service
Last updated: November 2, 2026
These Terms of Service ("Terms") are an agreement between you and Upstream Works LLC ("Upstream Works", "we", "us", "our") and govern your use of Roger, including our websites at roger.earth (such as www.roger.earth and go.roger.earth), the Roger web app at app.roger.earth, and related services (together, the "Service").
By accessing or using the Service, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, do not use the Service.
1. Who can use Roger
You must be at least 16 years old to use Roger, and able to form a binding contract. If you use Roger on behalf of an organization, you confirm you have authority to accept these Terms for it.
2. Accounts
Some features require an account. You can sign in with Google, with Apple, or with an email address and password; phone sign-in by text message may also be available. Keep your sign-in account and password secure, and tell us promptly at support@roger.earth if you think your account has been accessed without permission. You are responsible for activity under your account.
3. Early access and beta features
Roger is in early access. Features may be incomplete, change, or be removed, and access may be limited by invitation or a preview code. Do not share invitation or preview codes unless we allow it. We may end early access at any time.
4. What Roger does, and its limits
Roger suggests things to do, places to go, and plans based on your questions, your location, the needs and preferences you state or that Roger infers and remembers, and information from third-party sources such as place listings, event listings, weather, and transit data. Roger uses AI to write answers and shows where its information came from.
- Check before you go. Hours, prices, availability, events, weather, accessibility, and transit can change, and AI-generated answers can be wrong, incomplete, or out of date. Confirm important details with the source or venue.
- Unconfirmed needs. Roger aims to show a place as meeting a need only when it has a source for it. When Roger can't confirm a need that affects safety or access, such as an allergy or step-free entry, it asks you to call ahead and check. Other needs it can't confirm are not shown as met. You are responsible for confirming allergies, dietary needs, and accessibility directly with the place before you go.
- Not professional advice. Roger does not provide medical, legal, financial, or safety advice. Use your own judgment, especially about travel, health, allergies, and personal safety.
- Third parties. Places, venues, events, and services Roger suggests are run by third parties. We do not control them and are not responsible for their content, services, availability, or conduct. Any dealings you have with them are between you and them.
- Third-party links and data. The Service may link to or show content from other websites and services, which have their own terms and privacy policies.
5. Shared Paths
You can create a Path and invite others to it. Members of a shared Path can see each other's names, whether they are coming, non-sensitive needs, and votes. Only invite people you are comfortable sharing that with. Sensitive needs are not shown to other members. See our Privacy Policy.
6. Your content
"Your Content" means what you submit to Roger, such as questions, voice input, saved plans, needs and preferences, and feedback. You keep ownership of Your Content. You give us a worldwide, non-exclusive, royalty-free license to host, store, process, reproduce, and display Your Content as needed to operate, secure, and improve the Service and as described in our Privacy Policy. This license ends when you delete Your Content (for example, with "Delete my data", or by clearing chat threads stored in your browser), except for records we keep as described in our Privacy Policy, where we must keep it by law, or where it remains in backups for a limited time.
You are responsible for Your Content and confirm you have the rights needed to submit it.
Feedback. If you send us ideas or suggestions, we may use them without any obligation to you.
7. Acceptable use
You agree not to:
- break the law or violate anyone's rights;
- harass, threaten, or harm others, or use Roger to stalk or track a person;
- submit content that is unlawful, infringing, hateful, sexually explicit involving minors, or otherwise harmful;
- try to gain unauthorized access to the Service, other accounts, or our systems, or get around access controls, preview gates, or rate limits;
- scrape, crawl, or extract data from the Service by automated means, except as allowed by our robots.txt or with our written permission;
- reverse engineer the Service except where the law allows;
- interfere with or disrupt the Service, or introduce malware;
- use the Service to build a competing product or to train AI models; or
- misrepresent who you are or your affiliation with anyone.
8. Our intellectual property
The Service, including the Roger name, logos, software, design, and content we provide (other than Your Content and third-party content), belongs to Upstream Works LLC or its licensors and is protected by intellectual property laws. We give you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service as allowed by these Terms. You may not use our trademarks without our prior written permission.
9. Fees
The Service is currently free during early access. If we introduce paid features, we will tell you the price and terms before you are charged, and you will not be charged without agreeing.
10. Suspension and termination
You can stop using Roger at any time and use "Delete my data" in You. It clears this device's copy, including your chat threads, and deletes what your account holds. Our Privacy Policy explains what "Delete my data" deletes, what it does not delete, and what we keep. To delete waitlist data, email support@roger.earth. We may suspend or end your access if you breach these Terms, if required by law, or if needed to protect the Service or others. Where reasonable, we will tell you first. Sections 6 (feedback), 8, and 11 to 16 survive termination.
11. Disclaimers
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT THE SERVICE OR ANY SUGGESTION, ANSWER, OR THIRD-PARTY INFORMATION WILL BE ACCURATE, COMPLETE, CURRENT, UNINTERRUPTED, OR ERROR-FREE.
12. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, UPSTREAM WORKS LLC AND ITS MEMBERS, MANAGERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR US$100.
Some jurisdictions do not allow certain exclusions or limits, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited by law, or your rights as a consumer under mandatory local law.
13. Indemnity
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Upstream Works LLC from claims, losses, and expenses (including reasonable attorneys' fees) arising from your misuse of the Service, Your Content, or your breach of these Terms.
14. Disputes
Governing law. These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law rules. If you are a consumer, this does not take away any protection you have under the mandatory laws of the place where you live.
Informal resolution. Before either of us files a claim, the one with the dispute will send the other a written notice describing it and the outcome wanted (to us at support@roger.earth), and we will both try in good faith to resolve it for 30 days. This does not stop either of us from going to small claims court.
Dispute resolution forum. Except for small claims, and unless the law where you live gives you the right to bring a claim in your local courts, any dispute will be heard in the state or federal courts located in Washington, and you and we agree to their jurisdiction. Either of us may instead bring an individual claim in small claims court if it qualifies. If you are a consumer in the European Union, the United Kingdom, or Quebec, you may also bring a claim in the courts where you live. These Terms do not require arbitration.
15. Changes to these Terms
We may update these Terms from time to time. If a change is material, we will tell you at least 30 days before it takes effect, with a notice in Roger and by email if you have given us one. Changes needed for legal reasons, or that only cover new features, may take effect sooner. The "Last updated" date shows when these Terms last changed. Changes to section 14 will not apply to a dispute we already know about. If you keep using Roger after a change takes effect, the updated Terms apply. If you do not agree, stop using Roger and use "Delete my data".
16. General
These Terms, together with our Privacy Policy, are the entire agreement between you and us about the Service. If any provision is found unenforceable, the rest stays in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. There are no third-party beneficiaries.
Language. These Terms are written in English. Any translation is provided for convenience only, and the English version governs if there is any conflict.
